Acceptance of these termsقبول هذه الشروط
These Terms of Use govern your access to and use of the Areeka website, mobile apps and services (the “Services”), operated by Areeka Tech Ltd, a company registered in the Dubai International Financial Centre (DIFC), Dubai, UAE. By using the Services, you agree to these terms. If you do not agree, please do not use the Services.تحكم شروط الاستخدام هذه وصولك إلى موقع أريكة وتطبيقاتها وخدماتها («الخدمات») واستخدامك لها، وهي مُشغّلة من قبل شركة Areeka Tech Ltd المسجّلة في مركز دبي المالي العالمي (DIFC) بدبي، الإمارات. باستخدامك للخدمات فإنك توافق على هذه الشروط. وإذا لم توافق عليها، يُرجى عدم استخدام الخدمات.
Not for emergenciesليست للحالات الطارئة
Areeka is not an emergency service. If you are in crisis, having thoughts of harming yourself or others, or facing a medical emergency, please contact your local emergency number or nearest emergency department immediately. The Services are not a substitute for emergency or in-person care.أريكة ليست خدمة طوارئ. إذا كنت في أزمة، أو تراودك أفكار بإيذاء نفسك أو الآخرين، أو تواجه حالة طبية طارئة، يُرجى الاتصال فورًا برقم الطوارئ المحلي أو التوجّه إلى أقرب قسم طوارئ. لا تُغني الخدمات عن الرعاية الطارئة أو الحضورية.
Accounts and sign-inالحسابات وتسجيل الدخول
You can create an account without providing your name or email. We sign you in using a one-time passcode (OTP) sent to your phone number through our provider, Twilio. You are responsible for keeping access to your phone and account secure, and for activity that takes place under your account. You must be at least 18 years old (or the age of majority where you live) to use the Services.يمكنك إنشاء حساب دون تقديم اسمك أو بريدك الإلكتروني. ونسجّل دخولك عبر رمز تحقق لمرة واحدة (OTP) يُرسَل إلى رقم هاتفك من خلال مزوّدنا Twilio. أنت مسؤول عن الحفاظ على أمان هاتفك وحسابك، وعن الأنشطة التي تتم عبر حسابك. ويجب أن يكون عمرك 18 عامًا على الأقل (أو سن الرشد في بلدك) لاستخدام الخدمات.
Nature of the serviceطبيعة الخدمة
Areeka connects you with independent, licensed therapists who provide professional care. Sessions are delivered through Whereby, a third-party HIPAA-compliant video service; Areeka does not join, record or store your sessions. Therapists are responsible for the clinical services they provide. Areeka facilitates anonymous sign-in, matching, scheduling and payments, but does not itself provide medical advice.تربطك أريكة بمعالجين مرخّصين ومستقلّين يقدّمون رعاية مهنية. وتُقدَّم الجلسات عبر Whereby، وهي خدمة فيديو خارجية متوافقة مع معيار HIPAA؛ ولا تنضمّ أريكة إلى جلساتك ولا تسجّلها ولا تخزّنها. والمعالجون مسؤولون عن الخدمات السريرية التي يقدّمونها. تتيح أريكة تسجيل الدخول المجهول والمطابقة والجدولة والمدفوعات، لكنها لا تقدّم بنفسها استشارات طبية.
Bookings, payments and cancellationsالحجوزات والمدفوعات والإلغاء
Session prices are shown before you book. Payments are processed by a third-party payment provider; Areeka does not store your card details. You may cancel or reschedule a session free of charge up to 24 hours before its scheduled start time. Cancellations or changes made less than 24 hours before the session time, and missed sessions, are non-refundable.تُعرض أسعار الجلسات قبل الحجز. وتُعالَج المدفوعات عبر مزوّد دفع خارجي، ولا تخزّن أريكة بيانات بطاقتك. ويمكنك إلغاء الجلسة أو إعادة جدولتها مجانًا حتى 24 ساعة قبل موعد بدئها. أمّا الإلغاء أو التغيير الذي يتم قبل أقل من 24 ساعة من موعد الجلسة، وكذلك الجلسات الفائتة، فغير قابلة للاسترداد.
Your responsibilitiesمسؤولياتك
You agree to use the Services lawfully and respectfully, and not to misuse the platform, attempt to access it without authorisation, or interfere with its operation. You agree to treat therapists and staff with respect.توافق على استخدام الخدمات بشكل قانوني ومحترم، وعدم إساءة استخدام المنصّة أو محاولة الوصول إليها دون تصريح أو التشويش على عملها. كما توافق على معاملة المعالجين والموظفين باحترام.
Intellectual propertyالملكية الفكرية
All content, branding, software and design in the Services are owned by Areeka Tech Ltd or its licensors and are protected by law. You may use the Services for your personal use only and may not copy, modify or distribute them without our permission.جميع المحتوى والعلامات والبرمجيات والتصاميم في الخدمات مملوكة لشركة Areeka Tech Ltd أو مرخّصيها ومحمية قانونًا. ويحق لك استخدام الخدمات لأغراضك الشخصية فقط، ولا يجوز نسخها أو تعديلها أو توزيعها دون إذننا.
Disclaimers and limitation of liabilityإخلاء المسؤولية وحدودها
The Services are provided on an “as is” basis. To the fullest extent permitted by law, Areeka Tech Ltd is not liable for indirect or consequential losses arising from your use of the Services, or for the services delivered by independent therapists or third-party providers such as Whereby. Nothing in these terms limits liability that cannot be excluded under applicable law.تُقدَّم الخدمات «كما هي». وإلى أقصى حدّ يسمح به القانون، لا تتحمّل شركة Areeka Tech Ltd المسؤولية عن أي خسائر غير مباشرة أو تبعية ناشئة عن استخدامك للخدمات، أو عن الخدمات التي يقدّمها المعالجون المستقلّون أو المزوّدون الخارجيون مثل Whereby. ولا يحدّ أيّ بند في هذه الشروط من المسؤولية التي لا يمكن استبعادها بموجب القانون المعمول به.
Terminationإنهاء الخدمة
You may stop using the Services and delete your account at any time. We may suspend or terminate access if these terms are breached or where necessary to protect users or comply with the law.يمكنك التوقّف عن استخدام الخدمات وحذف حسابك في أي وقت. ويجوز لنا تعليق الوصول أو إنهاؤه عند مخالفة هذه الشروط أو عند الحاجة لحماية المستخدمين أو الامتثال للقانون.
Governing lawالقانون الحاكم
These terms are governed by the laws applicable in the Dubai International Financial Centre (DIFC), and disputes are subject to the jurisdiction of the DIFC Courts, unless mandatory local law provides otherwise.تخضع هذه الشروط للقوانين المعمول بها في مركز دبي المالي العالمي (DIFC)، وتخضع النزاعات لاختصاص محاكم مركز دبي المالي العالمي، ما لم ينص قانون محلي إلزامي على خلاف ذلك.
Changes to these termsالتغييرات على هذه الشروط
We may update these Terms of Use from time to time. When we make material changes, we will update the date above. Your continued use of the Services means you accept the updated terms.قد نحدّث شروط الاستخدام هذه من وقت لآخر. وعند إجراء تغييرات جوهرية، سنحدّث التاريخ أعلاه. واستمرارك في استخدام الخدمات يعني قبولك للشروط المحدّثة.
